 What are Lasting power of attorney documents

  

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint one or more people (known as attorneys) to make decisions on your behalf if you become unable to do so in the future due to illness, injury, or mental incapacity. There are two types of LPAs in the UK: one for health and welfare decisions, and another for property and financial affairs.

Types of Lasting Power of Attorney

Health and Welfare LPA:

  • Activation: Only comes into effect when you are deemed to lack the mental capacity to make such decisions yourself.

  • Scope: Covers decisions about your health and welfare, such as medical treatment, where you live, and your daily care needs.

 

Property and Financial Affairs LPA:

  • Scope: Covers decisions about your financial matters, such as managing bank accounts, paying bills, collecting benefits or pensions, and selling or renting out property.

  • Activation: Can be used as soon as it is registered, with your permission, or only when you lack mental capacity, depending on your preferences.
